Terms of Use for this website

This document states the terms which you must comply with when visiting any EEIO local community website (including the website on which you are viewing this notice). Please read these terms of use carefully before you start to use our site and check them regularly. By using any of our sites, you indicate that you accept these terms of use and that you agree to abide by them.

Information about us

EEIO websites are operated by EEIO Ltd (we, our, us), a Ltd company registered in England and Wales under company number 7857855 and have our registered office and principle trading address at The Red Brick Building, Morland Road, Glastonbury, Somerset, BA6 9FT.

Accessing our site

Access to our site is not guaranteed, from time to time we will withdraw or amend the content and service provided on our site without notice. We will not be liable if our site or any content is unavailable at any time for any reason. From time to time, we may restrict access to some parts of our site, or our entire site, including to users who have registered with us.

You are responsible for making all arrangements necessary for you to have access to our site, and for ensuring that everyone who accesses our site through your internet connection is aware of these terms, and that they comply with them.

If you decide to apply to become a registered user of our site, you may choose, or you will be provided with, a username, password and any other piece of information we deem necessary as part of our security procedures. You must treat such details and information as confidential, and you must not disclose it to any third party. You must provide us with your contact details in the form of your email address so that we can contact you when necessary. You must not impersonate or try to impersonate another person, disclose your password to anyone else, allow anyone else to use your account, or use anyone elses account. You are responsible for everything done using your account. If you think that someone else may have access to, or be using, your password or account, you must tell us as soon as possible by contacting us through the website. We have the right to disable any username or password, whether chosen by you or allocated by us, at any time.

Location Validation

In order to use access some of the features on our website, you may need to prove that you are local by allowing us to validate your name, postcode and/or location with us. In such cases you consent to us carrying out such checks, which may include charging you a small fee taken via credit or debit card payment. We reserve the right to reject any application to become a certified local in the event that you do not meet any of our requirements. If you move house you may transfer your account to your new town, although items published in your old town will remain published there.

Prohibited uses

You may use our site only for lawful purposes. You may not use our website:

- in any way that breaches any applicable local, national or international law or regulation;
- in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
- in any way that is detrimental to the wellbeing of our site;
- for the purpose of harming or attempting to harm any person in any way;
- to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (below);
- to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
- to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree:
- not to reproduce, duplicate, copy or re-sell any part of our site in contravention with these Terms.
- not to access without authority, interfere with, damage or disrupt any part of our site, any equipment or network on which our site is stored, any software used in the provision of our site, or any equipment or network or software owned or used by any third party.

Interactive services

We may from time to time provide interactive services on our site, including Messaging and Forums (interactive services).

Interactive services are not fully moderated. Any content submitted to our site, including to the interactive services (contribution) will be checked by us for compliance with our content standards (below) as soon as reasonably practicable before (in the case of News) and after (in the case of all other content) it is published. We cannot guarantee how quickly contributions will be checked as this will depend on other editorial commitments.

Although we will ensure that some moderation is carried out, we are under no obligation to you or any other person to oversee, monitor or moderate contributions or any other service we provide on our site. We reserve the right to remove, or to disable access to, any contribution which we deem to breach these terms of use. We expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

The use of any of our interactive services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not fool-proof. Minors who are using any interactive service should be made aware of the potential risks to them.

Content standards

EEIO is regulated by IMPRESS, the independent monitor for the press, and has adopted the IMPRESS Standards Code, Complaints Policy, Complaints Procedures and Whistleblowing Policy which you are required to adhere to. These procedures can be found by clicking on the IMPRESS logo on the front page of the website.

Particularly when posting in the NEWS area of the website, but also more generally, we require you to observe and enforce the ethical standards and guidelines set out in the IMPRESS Standards Code. http://impress.press/standards/

Contributions must be accurate (where they state facts), be genuinely held (where they state opinions), and comply with applicable law in the UK and in any country from which they are posted.

Contributions must not contain any material which is defamatory, obscene, offensive, hateful or inflammatory, promotes sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, infringes any copyright, database right or trade mark of any other person, is likely to deceive any person, is made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence, promotes any illegal activity, is threatening, abusive or invades anothers privacy, causes annoyance, inconvenience or needless anxiety, is likely to harass, upset, embarrass, alarm or annoy any other person, is used to impersonate any person, misrepresents your identity or affiliation with any person, gives the impression that it emanates from us, advocates, promotes or assists any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Due to the nature of the website, we may edit or remove any part or all of a contribution without notice, and you may be blocked from posting content.

Complaints

There are three ways to make a complaint about content on the website. You may request a correction, report an item as being unsuitable for publication in some way, or file a formal complaint. You may from time to time be asked to make corrections to contributions you have made and you hereby agree to either make the correction or enter into a dialogue with the editor as to why not, with the understanding that the issue may eventually escalate to judgement by IMPRESS.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Browsing our website

You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Uploading to our website

By submitting a contribution to the site, you agree to grant EEIO Ltd a non-exclusive, perpetual, irrevocable, royalty-free, transferrable and worldwide licence to use that contribution on its local publishing platforms and networks. The copyright in your contribution will remain your own, and you furthermore agree to grant to EEIO Ltd the right to use, edit, alter, reproduce, publish and/or distribute the material contained in your contribution. EEIO Ltd may exercise all copyright and publicity rights in the material contained in your contribution in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.

In accordance with the Content Standards (above), you must ensure that your contribution does not infringe any copyright, database right or trade mark of any other person. By submitting your contribution to the site, you are warranting that you have the right to grant EEIO Ltd the non-exclusive copyright licence described above.
We may occasionally premoderate your uploads, and in cases of obsenity or illegality, we may freeze your content while our lawyers examine it.

Other users may report your uploads as being unsuitable for publication on the website, and they may be removed from public view while we examine the report.

Other users may occasionally request corrections to your uploaded items and we request you consider these requests carefully.

Any material you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

Deleting your account

You may delete your account at any time. However, please be aware that for the purposes of local history, content uploaded by you will remain on the site, labelled as having been published by “Deleted User”, unless you first delete that content. We may also retain your details for up to 2 years as required by UK law after the deletion of your account.

Buying and selling using our website

It is solely up to the buyer and seller to honour any sales and make collection of any payments arranged using this website.

While we makes every effort to provide a good customer experience, we take no responsibility for delivery of any goods or services advertised on the website, with the exception of downloads, whose digital delivery we do guarantee.

We may occasionally request a 10% commission on the sale of works of art to help pay our server costs. You may refuse this request.

Reliance on information posted

Contributions, articles, commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

Our liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, any other members of our group of companies and third parties connected to us hereby expressly exclude:

- all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

Information about you and your visits to our site

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. You grant EEIO Ltd permission to combine your data with that of others in a way that does not identify you or any individual personally and share or publish summary results relating to such data and to distribute or license such data to third parties.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
